Terms and Conditions
November Learning Communities (NLC) is a community of websites for educators,
provided by November Learning, LLC. ("we" or "us"). We provide information, and
services for educators.

By “educators” we mean teachers, professors, school leaders, librarians or
professionals currently employed by an educational institution.

By “students” we mean individuals under the age of 18

By “Community” we mean a personal interactive website or blog
Terms of Use
This community blogging software service is not intended for students to open
or maintain accounts on our system. Students do not have November Learning’s
permission to create their own Community on our site. We reserve the right to
remove any student blogs on our system.
Educators may create an account for use in their classrooms or for their
professional purposes. If you are not an educator, you may not use our November
Learning Communities Service.
Students are permitted to participate within their educator’s Community,
provided that an educator is continuously administrating the site.
Educators may not create accounts for individual students, ie. accounts that
students will administer. Educator may not authorize anyone else to use their
Community with their account or password.
NLC strictly adheres to COPPA Guidelines. Since only educators can create paid
accounts within our services, our services do not request personal information
from students or children under the age of 13.
November Learning is not responsible or liable for anything posted or
information exchanged within your Community. The educator agrees to communicate
and participate at the educator’s own risk.
Educators may allow posting of comments to their site’s content. All comments
must be monitored by the educator.
It is the educator’s responsibility to ensure personal information is not being
used when approving comments to go “live” on their site. The comments feature
on each Community site asks for users to leave their name if they post a
comment. As a registered user it is the educator’s responsibility to have
students use pseudonyms or other non-identifying techniques. Educators should
not post content that might solicit private information from students. (See
COPPA Guidelines).
Security
November Learning has taken several steps to safeguard the integrity of its data
and prevent unauthorized access to information maintained on our systems. These
measures are designed and intended to prevent corruption of data, block unknown
or unauthorized access to our systems and information, and to provide
reasonable protection of private information in our possession.
When submitting sensitive data like personal ID numbers, we use secure server
technology to protect the information.
While every effort is made to maintain the security of our servers, no
computing environment can be 100% secure. Therefore, use of November learning's
web sites to transmit information is at you own risk. November learning
provides no warranty and assumes no liability.
We urge you to take every precaution to protect your personal data. It is
important for you to protect against unauthorized access of your access codes
and your computer. Do not share your access codes with others. Be sure to sign
off when finished using a shared computer.
Copyright Policy
The following policy was developed in accordance with the Copyright Law of the
United States of America and related laws contained in Title 17 of the United
States Code.
All text, files, images, videos, music, sounds, software, logos, charts,
layouts, designs, and information, as well as the underlying coding associated
with each web page found on November Learning web sites are the intellectual
property of November Learning, LLC., unless otherwise noted. November Learning
web sites are protected by United States copyright laws as a collective work.
Some web pages may contain content provided by a third party that holds a
copyright to the material.
Use of November Learning Material
In accordance with applicable laws, you may view, copy, print and use content
contained on November Learning web sites solely for your own personal use and
provided that: (1) the content is used for informational and noncommercial
purposes only; (2) no text, graphics, photos or other content is modified in
any way; (3) you include both a link to this notice and any copyright notice

technical limitations may occur. November learning provides this information

excluded. This means that educators use November Learning Communities at their
own risk and we are not promising that educators will obtain any specified type
of information or any minimum level of service.
The information provided on November Learning web sites is provided for
informational purposes only and does not constitute a contract with November
Learning. November Learning reserves the right to change or remove information
from November Learning web sites without notice.
Hypertext links to web sites that are not hosted by November Learning are
provided as a convenience and should not be considered an endorsement or
credibility of the service, information, or product offered through the linked
sites.
November Learning values and respects all personal and academic freedoms
afforded by law. Accordingly, November Learning does not monitor or restrict
information posted to many of the web pages found on nlcommunities.com domain
or within the range of I.P. addresses assigned to November Learning, including
but not limited to, those pages maintained by educators, and organizations that
are not formally part of November Learning. Therefore, the opinions expressed
and the information presented on such pages may not represent the opinions or
policies of November Learning.
November Learning reserves the right to remove any page on its servers that does
not observe the restrictions or provisions set forth by November Learning.
By participating in the Community, you agree that we, and those parties that
help us to create, maintain or deliver November Learning Communities content,
are not liable for any indirect, incidental, consequential, special or
exemplary damages (including for example, lost profits and damages from loss of
use) resulting from using November Learning Communities, unless the exclusion
of such damages is precluded by law. You agree to assume all risk and liability
arising from the use of our online services, including the risk of breach in
the security of our system. If your information is stolen as the result of a
breach in our system, or items meant to be private, such as private messages
and private entries, somehow become public, this is part of the inherent risk
you take in using our services. On the other hand, if you fail to follow these
terms at any time, we can immediately stop you from ever using November
Learning Communities again and you will be responsible for any damages that we
may suffer.
November Learning Communities Content
Anytime you post anything (pictures, graphics, information, articles, postings,
or data, audio, all of which we will generally refer to as "content") you are
giving us the right to edit it, copy it, make it part of something else and
publish it in any way or manner. If you post content, it is your responsibility
to make sure that you have permission to use it. You can continue to use the
content even after you post it, so long as you either own the content yourself
or the person owning the content gave you the right to use it.
All content posted must be aligned with the educator’s district policies
regarding imagery and student work.
Reporting Copyright Infringements
In accordance with the Digital Millennium Copyright Act ("DMCA"), Pub. L.
105-304, November Learning, LLC. has designated an agent to receive
notification of alleged copyright infringement on any November Learning web
page. If you believe that your copyrighted work is being infringed, notify:

discussions, although we are not obligated to do so. We have the right to
remove any or all content we receive from users of November Learning
Communities. We are not responsible for any material on the site that you might
find objectionable. November Learning reserves the right to send you related
materials from November Learning.
Links
Any presentation of November Learning materials that presents them with
commercial content attached or presents them so that they appear to be the
property or work of another is not permitted without prior written consent.
Therefore;
all links must be directly to a November learning, LLC. web page. Linking
directly to images, videos, music, sounds, software, logos, or files of any
type other than web page files (inline linking) is not allowed.
November learning, LLC. web pages may not be presented as the frame source of
any other site.
November Learning Communities may provide you with links to other sites. We are
not responsible for the information or services provided by those sites and the
fact that we provided you with a link to them does not mean that we endorse the
site or the information or services provided by the site.
Conduct on our Sites
You are responsible for your behavior and conduct while at any November
Learning Communities site. We retain the right to edit or delete any part of
the content that is published, displayed or distributed on the site. You also
agree that you will not (a) harass or stalk other users, that is, you won't
insult them or send them unwanted messages, (b) impersonate any other person or
identify yourself as anyone else, such as sending messages identifying yourself
as a November Learning staff member, (c) use vulgar, abusive or offensive
language while at November Learning Communities, (d) post material that could
reasonably be considered defamatory, libelous, threatening, obscene or vulgar,
offensive to racial or ethnic sensibilities or otherwise objectionable, (e) use
November Learning Communities to gather any type of personal information from
other people, such as, for example, email addresses, or (f) use November
Learning Communities to post advertising, promotional or solicitation material.
In addition, November Learning Communities will not permit any conduct that it
believes will keep others from using or enjoying the site.
USING THIS WEBSITE INDICATES THAT YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT
THESE TERMS, DO NOT USE OUR SERVICES. November Learning reserves the right to
add, renew, or change these terms at any time.
These Terms will take immediate effect to any educator who currently holds an
account on NLC or who is currently using the software even if the educator was
not aware of these Terms when they first created their account. If a current
educator does not adhere to these terms their site will be removed from our
system.
